Ohio Attorney General sues contractors for 8,000 over uncompleted repairs

COLUMBUS, Ohio — Ohio Attorney General Dave Yost has filed suit against Liberty Restoration and its owner Josh Basinger over fraud allegations related to $158,000 in home repairs that were not performed. The suit, filed in Franklin County Common Pleas Court, accuses the contractor of violating the state’s consumer protection laws.

“Mother Nature caused the damage, and now a dishonest contractor has made it even worse,” Yost said. “We are stepping in to recover these funds for the affected homeowners.”

The lawsuit alleges that Liberty Restoration offered its repair services in storm-affected areas and accepted deposits either directly from customers or in the form of checks from their insurance companies. However, many consumers have reported that the company either failed to complete the repairs, performed substandard work, or avoided their attempts to follow up. In addition, the lawsuit alleges that Liberty Restoration promised refunds that were never provided.

The Attorney General’s Office, along with the Better Business Bureau, has received 20 unresolved complaints about Liberty Restoration, totaling $158,000 in reported losses.

The lawsuit seeks to secure compensation for the affected homeowners, impose civil penalties, and enjoin Liberty Restoration from continuing its business until the required compensation is paid.

To avoid becoming victims of similar scams, the Attorney General’s Office advises consumers:

  • Find out about the contractor: Confirm the contractor’s identity, check their reputation with the Ohio Attorney General’s office and the Better Business Bureau, and ask for references.
  • Obtain multiple quotes: Get at least three written estimates to make sure you get a fair deal.
  • Avoid high prepayments: Pay in installments, e.g. one third at the beginning, one third halfway through and the last third upon completion.
  • Get everything in writing: Make sure all commitments and details are recorded in a written contract, including the use of subcontractors and required licenses.
  • Understanding cancellation rights: Please note that you normally have three days to cancel a door-to-door sales contract.
  • Pay with a credit card: Using a credit card can provide better protection against fraudulent charges.
