Alabama man faces third murder charge in Oklahoma

A third murder charge has been filed in Oklahoma against an Alabama man who was arrested in Arkansas, a prosecutor said.

Stacy Lee Drake, 50, was charged Wednesday with murder in the June 14 shooting death of Phillip Emerson at his El Reno home, Sequoyah County District Attorney Jack Thorp said in a statement.

Drake, whose first name is spelled “Stacey” in some court documents, had previously been charged with murder for shooting Tara Huber Underwood and Taylor Sharp at a store in Gans on June 18.

“This man’s senseless and violent actions have impacted people across the state,” Thorp said. “These victims and their families deserve justice.”

A lawyer for Drake declined to comment Thursday.

Drake also faces robbery, possession of a stolen vehicle and a number of felony charges, allowing Sequoyah County prosecutors to charge him with murder in El Reno, Canadian County.

Tuscaloosa County Sheriff’s Office Captain Jack Kennedy said Drake is wanted in the state for murder, but court records show no formal charges.

A phone message seeking comment was left Thursday for a Tuscaloosa County Sheriff’s Office spokesman.

An affidavit in the Oklahoma killings alleges that Drake killed Emerson in El Reno, a western suburb of Oklahoma City, and stole his truck. The vehicle was later found near the store in Gans, about 100 miles east of Oklahoma City.

Underwood’s vehicle, which was taken from Gans, was found on June 20 at a motel in Morrilton, Arkansas, about 40 miles northwest of Little Rock. Drake was later arrested in a nearby wooded area.
